If your company has more then 10 employees, the act applies this formula:
Gratuity = (Last Drawn Salary × 15/26) × Completed Years of Service
- Where,
- Last Drawn Salary = Basic Salary + Dearness Allowance (DA)
- 15/26 = Represents 15 days of salary for each year (26 working days in a month).
- Years of Service – Rounded to the nearest full year (e.g., 5 years 8 months = 6 years)
Formula for employees Not Covered under the Gratuity Act
In this, private companies with fewer then 10 employees may still offer gratuity, but the calculation of that is different.
Gratuity = (15 × Last Drawn Salary × Years of Service) / 30
(Gratuity Calculation for Private Employees)
In that, 30 days are count/considered instead of 26 days.
How to Calculate Gratuity Amount

Let’s take an example of gratuity calculation for an employee who has 10 years of service with salary of 60,000 rupees.
Details of Employee:
- Last Basic Salary + DA = ₹60,000
- Years of Service = 10 years
- Employer is covered under the Gratuity Act.
Calculation:
Gratuity = (Last Drawn Salary × 15/26) × Completed Years of Service
- = (60,000 × 15/26) × 10
- = (34,615) × 10
- = ₹3,46,150

Gratuity Tax Rules in India (2025)
- For the Government Employees: Gratuity is completely tax-free.

For the Private Employees (covered under the Gratuity Act):
You don’t have to pay tax on the lowest of these three:
- ₹20 lakh
- The actual amount of gratuity you got
- 15 days’ salary × number of years you worked
- Private Employees (not covered under the Act):
The gratuity amount is taxable, and tax will be charged as per your income tax slab.
